Is Voice Recording Legal in India? A Guide for AI Wearable Users

There is no single "recording law"
India has no statute that simply says "you may (or may not) record a conversation you are part of". Several bodies of law overlap.
1. The right to privacy
In 2017 the Supreme Court held that privacy is a fundamental right. Recording someone secretly can intrude on that right, especially in private settings.
2. The DPDP Act, 2023
The Digital Personal Data Protection Act governs processing of personal data — and a transcript of what someone said is personal data. Purely personal or domestic use is treated differently, but recording for work — client calls, interviews, patient meetings, customer conversations — can make you responsible for handling that data lawfully, usually starting with notice and consent.
3. Phone calls
Interception of calls by third parties is regulated under telecom law. Recording a call you are on is a different act, and courts have looked at it case by case — weighing privacy against relevance as evidence. Do not assume a secret call recording will be admissible or harmless.
4. Places and institutions
Courts, many hospitals, exam halls, government offices and most employers have their own rules. These apply regardless of the general law.
